Changes to Privacy Law - small business exemption to be removed and a few other changes

27 April 2009

If you have a turnover of more than $3 million or are subject to the Anti-Money Laundering and Counter-Terrorism Financing Act, the Privacy Act applies to you.

But even if you don’t fall into these categories, privacy laws could soon apply to you.  The Federal Government expects to produce new privacy legislation later this year.

The legislation may implement a number of recommendations from the Australian Law Reform Commission, including a recommendation that the existing small business exemption be removed.  (This is the exemption for organisations with a turnover of less than $3 million.)

The new legislation is also likely to outline an individual’s rights to access and correct their own personal information.
